This Public Offer (hereinafter referred to as the “Offer” or the “Agreement”) is an official proposal of LLC “Group TETA” (TIN 5029219972, PSRN 1175029009132, address: Premises 56, 11 Krupskoy St., Mytishchi, Moscow Region, 141002, Russian Federation, hereinafter referred to as the “Provider”) to provide services to Website Users as set out in this Offer, to persons recognized as Customers under the terms of this Offer.

For the purposes of this Agreement, the Provider and the Customer are hereinafter jointly referred to as the “Parties.”

The Provider publishes this Offer for remote provision of Services on the website https://hazelbush.tech/ (the “Website”).

1. General Provisions

1.1. This document is a public offer in accordance with Clause 2 of Article 437 of the Civil Code of the Russian Federation (hereinafter referred to as the “CC RF”) and contains all essential terms of the Agreement.

1.2. Placement of an order and payment for the Provider’s services shall constitute acceptance of this Offer.

1.3. A person who places an order and pays for the Provider’s services is deemed to be the Customer who has accepted this Offer.

1.4. Acceptance of the Offer (placement and payment of an order) means the Customer’s full and unconditional consent to the terms of this Offer.

2. Subject of the Offer (Agreement)

2.1. The Provider undertakes to provide the Customer with a secure network access service through the Secure Network Access Service (hereinafter referred to as the “Service”), and the Customer undertakes to pay for the Service.

2.2. Essential characteristics of the Service, tariffs, access period, service terms, and limitations are specified on the Website. Ordering the Service means the Customer’s (Website User’s) consent to the Service price, service terms, as well as other terms defined by this Offer, the User Agreement, the Privacy Policy, service terms, tariffs, and other documents published on the Website.

3. Order Placement and Payment

3.1. The order is placed by the Customer through the Website interface. The Customer shall provide accurate information when placing and paying for an order.

3.2. Payment methods: bank card payment on the Website.

3.3. Payment is deemed made when funds are received by the Provider.

4. Access Provision Procedure

4.1. The Secure Network Access Service is provided electronically and is not a tangible product.

4.2. Access to the Service is provided electronically through the personal account or in accordance with instructions sent to the email address specified by the Customer when placing the order.

4.3. Access activation period: within 24 (twenty-four) hours from payment confirmation.

4.4. The Provider’s obligations are deemed fulfilled from the moment the Customer is provided with information required to activate access to the Service.

5. Refunds

5.1. Refund terms are determined by the “Return Policy” section and the legislation of the Russian Federation.

5.2. Refund of funds paid by the Customer (or paid by third parties on behalf of the Customer) for the Service is possible before actual activation of access to the Service, as well as in other cases provided for by the legislation of the Russian Federation.

5.3. The refund period shall not exceed 10 (ten) calendar days.

6. Liability of the Parties

6.1. For non-performance or improper performance of obligations under this Offer, the Parties shall be liable in accordance with the legislation of the Russian Federation.

6.2. The Provider shall not be liable for losses caused by the Customer’s violation of connection instructions, other violations committed by the Customer, blocks imposed by third parties, and any other circumstances beyond the Provider’s reasonable control and/or independent of the Provider.

6.3. The Customer confirms that they undertake to use the Service exclusively for lawful purposes and bear full independent responsibility for compliance with the legislation of the Russian Federation, including compliance by the Customer and by any third parties to whom access to the Service was provided by the Customer under the relevant tariff terms and/or using credentials provided to the Customer.

6.4. The Provider and the Customer, taking into account the nature of the Services provided, undertake to use pre-trial dispute resolution procedures (negotiations, correspondence) in case of disputes and disagreements related to the provision of Services. If a dispute cannot be resolved pre-trial, the interested Party may apply to a court at the Provider’s location, unless otherwise established by the legislation of the Russian Federation.

7. Final Provisions

7.1. The law of the Russian Federation shall apply to relations between the Parties.

7.2. This Offer enters into force from the moment of publication on the Website and remains valid until the Offer is revoked/amended by the Provider.

7.3. The Provider may amend the Offer unilaterally.

The new version of the Offer enters into force from the moment of publication on the Website.
